My practice is limited to representing businesses, high net-worth individuals, bankruptcy trustees, creditors’ committees, assignees, union health, welfare and pension funds, landlords and attorneys in out-of-court restructuring of debt, bankruptcy, and assignments for the benefit of creditors in Chicago and throughout the United States. On the litigation side of these issues, we have substantial experience defending and prosecuting preference and fraudulent conveyance actions, corporate “veil-piercing” actions, officer and director fraud and breach of fiduciary duty litigation, and the rejection of union collective bargaining agreements under the provisions of the United States Bankruptcy Code. I have spoken on these issues at various bar association seminars and published articles in the Illinois Bar Journal and the Chicago Bar Association Magazine.

  • Represented the Prevailing Defendants in a Case of First Impression Before the United States Court of Appeals for the Seventh Circuit, Establishing the Commencement Date of Avoidance Action Statute of Limitations Upon the Appointment of a Chapter 7 Bankruptcy Trustee
  • Represented the Debtor in an Out-of-Court Liquidation of Its Appliance Stores and Warehouses, Resulting in the Full and Complete Release of the Owners’ Guaranty Obligations to Their Lenders
  • Successful Renegotiation of $35 Million of Bank Debt for a Commercial Real Estate Developer
  • Defeated an Attempt by a Debtor To Reject a Collective Bargaining Agreement in the United States Bankruptcy Court for the Northern District of Illinois
  • Represented the Debtor in the Sale of Its American Business and Mexican Operating Subsidiary Through an Assignment for the Benefit of Creditors
  • Represented the Purchaser in the Purchase of Substantially All of the Assets of a Chapter 11 Debtor in Indianapolis, IN
  • Represented Unofficial Committee of Debenture Holders in Major Real Estate Chapter 11 Case in Puerto Rico
  • Represented Official Unsecured Creditors Committee in Major Food Distributor Chapter 11 Case
– Represented Multiple Defendants in State Court Preference and Fraudulent Conveyance Litigation Brought Under the Ohio Insurance Liquidation Statutes
– Represented an Officer and Director of a Large Financial Institution in a Lawsuit Alleging Breach of Various Fiduciary Duties
